Name and Spelling Correction in India: Fix the Record, Not Your Name

• 1. List every document that carries your name and write down exactly how each spells it.
• 2. Find the majority. Usually most documents agree and one or two do not.
• 3. Find the oldest correct one. Your birth certificate or Class 10 certificate is normally the anchor, because everything downstream was copied from it.
• 4. The odd one out is your target. That is the record to correct, not your name.
• 5. If the oldest document is the wrong one, that is your first correction, because fixing it makes every later correction easier to justify.

Aadhaar

Take your existing Aadhaar and an accepted supporting document to any Aadhaar Kendra. UIDAI maintains its own list of accepted proofs and revises it, so check the current list on uidai.gov.in or at the Kendra rather than relying on a blog.

The warning that matters. UIDAI allows a name update in Aadhaar only twice in a lifetime. A correction uses one. If your Aadhaar is right and something else is wrong, leave Aadhaar alone and fix the other document.

PAN

Apply online through NSDL or UTIITSL under changes or correction in existing PAN data. The PAN system verifies against Aadhaar, so make sure your Aadhaar carries the spelling you want before you apply.

Correcting a Birth Certificate Under the RBD Act

This is the one people most often take to the gazette by mistake.

Section 15 of the Registration of Births and Deaths Act, 1969 provides that where the Registrar is satisfied an entry is erroneous in form or substance, or was fraudulently or improperly made, the correction is made by a suitable entry in the margin, signed and dated, without altering the original entry.

So a misspelt name on a birth certificate is a Registrar matter, at the municipal body or panchayat where the birth was registered. It is not a gazette matter and it does not need an affidavit sworn in Delhi.

Separately, Section 14 covers a birth registered without a name at all, where the parent or guardian gives the name to the Registrar within the period the state rules prescribe. Ask your local Registrar what window applies, because it varies by state.

School and Board Records

While your child is in school and no board certificate exists, the school corrects its admission register on an affidavit and the birth certificate. It is a desk job.

Once a board certificate has been issued, it becomes the board's matter and the rules tighten. Boards generally distinguish a genuine spelling correction from a full name change, and treat corrections more lightly, but each has its own window and its own form. Passport

A correction is handled through a reissue application. Update Aadhaar and PAN first so your supporting documents agree, then apply on passportindia.gov.in and download the current checklist from there rather than reusing a format from a blog.

Correcting Your Name in PF and UAN Records

This has changed recently and most pages still carry the old advice.

EPFO members whose UAN was issued after 1 October 2017, with Aadhaar-linked e-KYC, can now self-correct common personal details including the name, online, using an Aadhaar OTP, without employer verification or EPFO approval, and without supporting documents. On the member portal the option sits under Modify Basic Details, though EPFO has been refreshing the portal and the label may read Profile or Edit Profile, so go by the live screen.

Where the UAN was issued before 1 October 2017, the employer can make the correction without EPFO approval, with simplified document requirements. Where the account is not Aadhaar-linked, the request goes physically through your employer and then to EPFO for approval.

So check your UAN issue date and your Aadhaar linking first. If you fall in the first group, this is a ten-minute job you can do yourself, not a month of chasing HR.

Bank, Demat and KYC Records

Do these after PAN, since KYC records take the name from PAN. For demat and mutual fund folios the request goes to the registrar rather than the broker.

Voter ID and Driving Licence

Voter ID corrections go through Form 8 on the voters portal. Driving licence corrections go through your RTO on the Parivahan portal. Both are independent of the others, so timing is flexible.

Correcting a Registered Property Document

The highest-stakes case in this topic, and nothing ranking for this keyword covers it.

A misspelt name in a registered sale deed, gift deed or partition deed is corrected by a rectification deed, sometimes called a correction deed. The essentials:

• All the original parties must agree and sign it, along with two witnesses.
• It is registered at the same Sub-Registrar's Office where the original deed was registered, under the Indian Registration Act, 1908.
• Stamp duty for a minor typographical correction is usually nominal, often a small fixed amount, though it varies by state and rises where the correction touches property area or value.
• You do not rewrite the original deed. The rectification deed sits alongside it and corrects it.

If the other party will not sign, or cannot be traced, this stops being a documentation matter. Section 26 of the Specific Relief Act, 1963 allows a court to order rectification where a mutual mistake means the document does not reflect what the parties intended. That is a lawyer's job, and for anything touching title or a sale in progress you should be taking a property lawyer's advice anyway.

Caste and Community Certificates

Go back to the issuing authority, usually the Tehsildar or revenue office. Correcting the certificate is faster and cheaper than changing your name to match it, and a name change does not affect caste status in any event. The full caste-record picture is on our surname change guide.

• Several records disagree, no single one is clearly correct, and multiple offices are blocking you.
• The institution in front of you has asked for a gazette notification by name.
• You are not correcting a letter but adopting a different name.
• Your school certificate carries a name you never used and every later document copied it, so there is no correct record to point at.
• A foreign employer, university or consulate wants one published document that settles the question.
